Data Protection

Thank you for visiting our website and for taking an interest in our company. Data protection is an important topic to DMG Chemisch-Pharmazeutische Fabrik GmbH as the controller pursuant to Art. 4 (7) of the GDPR (hereinafter referred to as ‘DMG’) and the operator of the website www.dmg-dental.com. Protecting your rights to privacy is very important to us. This is why we have constructed our website in line with the principle of keeping usage of your data to a minimum.

Collection of personal data when visiting our website

If you wish to visit our website, we will only collect the following technically necessary data to display our website and ensure its stability and security. The legal basis for this is our legitimate interest pursuant to the first sentence of Art. 6 (1) (f) of the GDPR.

The following data are collected:

  • IP address
  • Date and time of the request
  • Time zone difference from Greenwich Mean Time (GMT)

  • Access status / HTTP status code
  • The data volume transferred in each case
  • The website the request originated from
  • Browser

  • Browser software language and version.

The personal data that we receive when you use our online services is collected and used strictly within the legally permitted framework and solely for the purpose you supplied the data for (e.g. requesting information materials, posting comments, subscribing to newsletters). The data collected is subject to extensive security measures that prevent unauthorised access, stop misuse and protect against the destruction or loss of data. Data is SSL-encrypted before being transmitted over the internet. The 128-bit encryption according to this method is deemed secure on the basis of current technological knowledge. Standard browsers support this SSL procedure.

When you contact us by email or using a contact form on this website, we will store the data you provide (your email address, your name and telephone number, if applicable, and the content of your message) to answer your questions. Your data will be processed in the context of pre-contractual measures or based on your express consent pursuant to the first sentence of Art. 6 (1) (a) and Art. 6 (1) (b) of the GDPR. We erase the data collected in this context once storage is no longer necessary or restrict processing if legal retention periods exist. We collect the following data when you contact us via our website:

  • The IP address of the target email server
  • Date and time of the request
  • The email address of the sender
  • The email address of the recipient.

If the content of your email is confidential in nature, we strongly advise that you encrypt it to protect it against unauthorised access or changes during transmission.

Rights of data subjects

You have the right to assert the following rights as a data subject with regard to your personal data at any time and free of charge:

  • The right of access.
  • The right to rectification or erasure.
  • The right to restriction of processing.
  • The right to object to processing.
  • The right to data portability.

You also have the right to lodge a complaint with a data protection supervisory authority regarding our handling of your personal data.

Revocation of consent and objection to the processing of your data

If you have given consent to the processing of your data, you can withdraw this consent at any time. Such a withdrawal influences whether processing of your personal data is permissible after you have notified us of the revocation.

If processing of your personal data is based on a consideration of interests, you can object to the processing. This is especially the case if the processing is not required for the fulfilment of a contract with you, which we will outline in the following description of functions. When exercising such an objection, we ask you to explain the reasons why we should not process your personal data as we have done. If your objection is well-founded, we will review the situation and either discontinue or adjust data processing or provide you with our compelling legitimate grounds for continuing the processing.

Further functions and services on our website

In addition to the purely informational use of our website, we offer various services that you can access if they are of interest. For this purpose, you will usually need to provide further personal data which we use to provide the respective service and for which the aforementioned data processing principles apply.

In some cases, we use external service providers to process your data. These have been carefully chosen and commissioned by us, are bound by our instructions and are subjected to regular checks.

Where our service providers or partners are based in a country outside the European Union (EU) or the European Economic Area (EEA), we will advise you of the consequences thereof at the appropriate point in this privacy policy.

Cookies

Cookies are small text files transmitted to your computer together with the online data actually requested. This data is saved on your computer in readiness for subsequent visits.

We use the consent management platform (CMP) of Cookiebot, a service provided by Usercentrics GmbH, Sendlinger Str. 7, 80331 Munich, Germany. The tool allows you to conveniently manage your consent to the setting of technically non-essential cookies and to make changes in this respect using the tool (e.g. revoking granted consent or making objections).

The information required under Art. 13 of the GDPR on the processing of your personal data by the Cookiebot CMP and by technically non-essential cookies can also be found in the tool.

How to disable or enable cookies: Click on the blue-and-white cookie icon on the right edge of the page. A pop-up window will appear, showing the cookies used by the website, which are divided into the following categories: ‘Necessary’, ‘Preferences’, ‘Statistics’, and ‘Marketing’. Clicking on the ‘Show Details’ tab will expand the window to show more information about the cookies, such as the name, provider, purpose, expiry, and type. You can disable or enable the cookies by clearing / selecting the check boxes next to the categories.

Newsletter

If you wish to receive the newsletter offered on our website, please be advised that any data entered into the newsletter registration screen will be used exclusively for the purpose of sending our newsletter, which contains information on all of our services.

We use your personal data such as your name, address, telephone number, email address or signature (collected, for example, through forms on this website, or your digital signature through a visit by our external sales team) solely for the intended purpose (e.g. to process your enquiry).

We need your explicit consent pursuant to the first sentence of Art. 6 (1) (a) of the GDPR to send you our newsletter. You can revoke the consent you have given at any time. Once your registration is complete, we will send you a confirmation email containing a link you must click on to finalise the order (‘double opt-in’). The registration may be undone at any time by clicking on the ‘Unsubscribe’ link. If, for example, you have asked us for information on products or services, we will use your data to provide you with the relevant information. To this end it may be necessary for DMG to forward your data to affiliated companies as well as partner companies for the fulfillment of contracts. You may also revoke this consent at any time with effect for the future.

You can send your revocation of consent in text form to privacy(at)dmg-dental.com or by post to DMG Chemisch-Pharmazeutische Fabrik GmbH, FAO Data Protection Officer, Elbgaustr. 248, 22547 Hamburg.

Processing of job applicant data

Data required for establishing contact and for the purposes of the application process will be collected and stored in compliance with the data protection regulations. The legal basis for this is our pre-contractual relationship and the data required for carrying out the application process pursuant to the first sentence of Art. 6 (1) (b) of the GDPR and Section 26 (1) in conjunction with the second sentence of Section 26 (8) of the German Federal Data Protection Act (BDSG).

If their application is rejected, applicants’ data will in any case be stored for evidence purposes for up to six months after the end of the application process for the purpose of asserting, exercising or defending legal claims. The legal basis for this is the first sentence of Art. 6 (1) (f) of the GDPR. If you have consented to further storage of your personal data pursuant to the first sentence of Art. 6 (1) (a) of the GDPR, we will transfer your data to our applicant pool until you revoke this consent. In any case, the data will be erased after one year unless you revoke your consent beforehand. If you have been offered a position during the application process, the data from the applicant data system will be transferred to our HR management system. Information on the storage period can be found in the data protection information for our employees.

The provision of the data is not required by law or contractually prescribed. You are not obligated to provide the data. However, if the data are not provided, this will make carrying out the application process and, if applicable, recruitment, impossible.

Processing of customer data

In the context of processing customer data, we collect and store data to the extent necessary for the intended purpose (e.g. first and last name, postal address, email address, telephone number/fax number, goods ordered/service provided, customer enquiry information and date of enquiry).

We process this data (with the exception of your IP address) for the fulfilment and processing of contracts with you (including payment processing), customer enquiries and for our own advertising purposes in accordance with the applicable privacy regulations.

The legal basis for the processing of customer data is Art. 6 (1) (b), (c) and (f) of the GDPR. Your data is deleted once it is no longer required for its intended purpose as far as this does not conflict with statutory retention requirements (especially the HGB/German Commercial Code and AO/German Tax Code requirements).

Event registration

Our website offers you the opportunity to register for various events. We collect the following personal data from you to process such a registration:

  • First name
  • Last name
  • Email address
  • University / dental clinic / laboratory.

The data collected from you will only be processed for the specified purpose and will only be stored for as long as is necessary to fulfil this purpose. If you agree to receiving information about upcoming and similar events by email when registering for an event, we will also process the data collected for this purpose. The legal basis in any case is your consent pursuant to the first sentence of Art. 6 (1) (a) of the GDPR. You can revoke your consent at any time with effect for the future.

We use the Zoom video conferencing platform to hold online events. When registering for an online event, you will therefore be redirected to a page of Zoom Video Communications Inc. to complete the registration. As Zoom is a US company, personal data may also be transferred to the USA. As the USA is classified as a third country from a data protection perspective, the level of data protection is not comparable to that which applies here. Further protective measures must therefore be taken prior to the transfer. In addition to the standard contractual clauses of the European Commission, Zoom Inc. uses further technical security measures, such as additional data encryption.

Further information on this subject is provided by Zoom Inc. at: https://explore.zoom.us/en/gdpr/.

The privacy policy of Zoom Inc. can be found at: https://explore.zoom.us/en/privacy/.

Photo and film recordings of events
We would like to inform you that we take photos and film recordings that involve references to persons at events. The purposes of data processing will be specified clearly for each event and always relate to corporate communication and documentation. These corporate purposes are pursued through the publication of social media posts, photos and videos on the Internet on the company’s website or by archiving recordings internally, for example. In this respect, the legal bases of consent according to Art. 6(1) (a) GDPR apply and, in the case of overriding business interests, legitimate interest according to Art. 6(1) (f) GDPR. The recordings will be erased once the purpose no longer applies, if previously granted consent is withdrawn or in the event of an objection.

Use of social media plugins

This website uses ‘social plugins’ of the social networks Facebook, Instagram, Twitter, Pinterest and Xing, which are operated by

  • Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (Facebook & Instagram);
  • Twitter Inc., 795 Folsom St., Suite 600, San Francisco, CA 94107, USA;
  • Pinterest Inc., 505 Brannan St., San Francisco, CA 94107, USA;
  • and New Work SE, Dammtorstraße 30, 20354 Hamburg, Germany

. The website uses what is known as the ‘two-click solution’. This means that, when you visit our site, generally speaking no personal data are initially passed on to the providers of the plugins. You can recognise the provider of the plugin by means of the logo. We offer you the opportunity to communicate directly with the provider of the plugin using the button. Only if you click on and thereby activate the marked field will the plugin provider receive the information that you have accessed the corresponding website on which we have an online presence. The data mentioned under (4.1) of this policy will be transferred too. In the case of Facebook, according to the respective providers in Germany, the IP address is anonymised immediately after collection. Activating the plugin transfers your personal data to the plugin provider in question, and stores it on their servers (in the case of US providers, in the USA).

We would like to point out that there is currently no adequate level of protection for data transfers to the USA. We cannot, therefore, currently guarantee that the US plugin providers can ensure an equivalent level of data protection as we do when processing your data. If you nevertheless wish to communicate with the plugin provider using the button in question, this therefore also includes processing of your data in the USA in accordance with the provisions applicable there. Further information on the terms of use and data protection practices of the plugin providers in question can be found below.

We have no influence over the data collected and the data processing operations, and neither are we aware of the full extent of the data collection, the purposes of processing or the storage periods. We also have no information concerning the plugin provider’s erasure of the collected data.

To the best of our knowledge, the plugin provider stores the data collected about you as user profiles and uses these data for the purposes of advertising, market research and/or needs-based website design. Such an evaluation is carried out in particular (even for users who are not logged in) for the display of needs-based advertising and to inform other users of the social network of your activities on our website. You have the right to object to the creation of these user profiles, whereby you must contact the plugin provider in question to exercise this right. By means of the plugins, we offer you the opportunity to interact with social networks and other users so that we can improve our online presence and make it more interesting for you as a user. The legal basis for use of the plugins is Art. 6 (1) (a) of the GDPR.

The data transfer takes place regardless of whether you have an account with the plugin provider and are logged in there. If you are logged into the plugin provider’s website, the data we collect is directly assigned to your account with the plugin provider. If you click the activated button and link to the page, for example, the plugin provider also saves this information in your user account and shares it publicly with your contacts. We recommend that you log out regularly after using a social network, but especially before activating the button, since this will help you to avoid assignment to your profile with the plugin provider.

For further information on the purpose and scope of data collection and data processing by the plugin provider, please refer to the privacy policies of these providers listed below. You will also find further information there about your rights in this regard and potential settings you can make to protect your privacy.

Consequently, processing there also takes place based on the locally applicable data protection laws. We cannot guarantee at present that Google will apply a data protection standard equivalent to ours when processing your data. If you consent to use of the Google services in question, your consent therefore also includes processing of your data in the US in accordance with the locally applicable regulations. We have provided information below about the Google services we use:

According to YouTube, in ‘Privacy-Enhanced Mode’ data (specifically which of our webpages you have visited) is only transmitted to YouTube’s server if you watch the video. If you are logged into YouTube at the same time, this information will be linked to your account with YouTube. The map will only be displayed to you in our CMP once you have given prior consent to this effect. Consent can be revoked at any time in our CMP.

Google Analytics

This website uses Google Analytics, a web analytics service provided by Google Inc. Google Analytics uses ‘cookies’, which are text files stored on your computer to help analyse your use of the website. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States.
However, if what is known as ‘IP anonymisation’ is activated on the website, Google will first truncate the IP address within the member states of the European Union or in other states that are party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA before being truncated. Acting on behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of this website, generating reports on the activities on this website and providing other services relating to internet activity and usage to the website operator. Google will not associate the IP address transmitted by your browser as part of Google Analytics with any other data held by Google. You can prevent the setting of cookies by adjusting your browser software appropriately; however, we would like to point out that, in this case, you may be unable to use all the features of this website.
In addition, you can block the transmission to Google of data captured by cookies with regard to your use of this website (including the IP address) and may further prevent Google from processing this data by downloading and installing this browser plug-in: http://tools.google.com/dlpage/gaoptout?hl=en. For more information, please visit: http://www.google.com/intl/en/analytics/privacyoverview.html (general information on Google Analytics and privacy). Please note that Google Analytics on this website has been expanded to include the gat._anonymizeIp() code. This is used for the purpose of anonymised storage of IP addresses (‘IP masking’).

Google Ads

We also use ‘Google Ads’, the Google advertising tool, to advertise our website. In doing so, our website uses the Conversion Tracking analytics service provided by the company Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter referred to as ‘Google’). If you accessed our website by means of a Google advert, a cookie is stored on your computer. Cookies are small text files that are saved on your computer by your internet browser. These conversion cookies become invalid after thirty days and cannot be used to identify you personally. If you visit certain pages of our website and the cookie has not yet expired, this allows us and Google to identify that you as a user have clicked on an advert we placed with Google and were then forwarded to our page.

Google uses the information generated by conversion cookies to create site visit statistics for our website. These statistics tell us the total number of users that have clicked on our advertisement and, furthermore, which pages of our website were then accessed by the relevant user. Neither we nor any other Google Ads advertisers receive any information that would enable us to personally identify users.

You can prevent the installation of conversion cookies by adjusting your browser’s settings accordingly (i.e. the browser setting that disables the automatic setting of cookies generally or blocks cookies from the domain googleadservices.com specifically).

For more information, contact Google directly at https://ads.google.com/intl/de_de/home/faq/gdpr/.

Google AdSense

We use Google AdSense on our website. Google AdSense is a service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, used to integrate advertisements. Google AdSense uses ‘cookies’, which are text files that are stored on your computer to help the website analyse how users make use of our site. Google AdSense also uses ‘web beacons’. Google uses these web beacons to analyse information, such as, for example, the flow of visitors to our site. This information, along with your IP address and a record of the advertising formats displayed, is transmitted to Google in the USA, where it is saved and may be passed on to Google’s contractual partners. However, Google will not combine your IP address with any other data stored about you. You can prevent the installation of cookies by adjusting your browser settings appropriately; however, we would like to point out that, in this case, you may be unable to use all the features of our website in full. By using our website, you agree to data collected by Google about you being processed as described above and for the above-mentioned purpose.

Google Remarketing: Our website uses the Google Remarketing service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter referred to as ‘Google’). Google Remarketing is used to post advertisements for users that have already visited our website in the past. This allows adverts tailored to their interests to be displayed on our site within the Google advertising network. Google Remarketing uses cookies for this analysis. Cookies are small text files that are stored on your computer to help the website analyse how users make use of the site. This makes the repeat recognition of our visitors possible as soon as they access websites within the Google advertising network. This facilitates the display within the Google advertising network of advertisements specific to content that the visitor has previously accessed on other Google advertising network websites where Google’s Remarketing function is used. According to its own information, Google does not gather any personal data during this process. You can disable this function by adjusting the settings accordingly at www.google.com/settings/ads.

Google Tag Manager

The activation of Google Analytics as well as other marketing tags is systematically controlled via Google Tag Manager so that the website does not lose performance when using various tags (code units, tracking tools, etc.). The Tag Manager triggers events related to marketing analysis or optimises them without using cookies itself or processing personal data. You can find detailed information on Google Tag Manager at https://www.google.de/tagmanager/faq.html. The legal basis is Article 6(1)(f) of the GDPR and our legitimate interest in a quick and uncomplicated management of various tools on our website. If appropriate consent has been given, the legal basis is Article 6(1)(a) of the GDPR; consent can be revoked at any time.
